Last updated 16 October 2026. This disclaimer applies to everything published on Midnight Futures, including lessons, journal entries, streams, images, downloads, emails, and any social-media account operated under the Midnight Futures or Scott West names. By using this site you agree to it.
1. Educational purposes only
All content on Midnight Futures is provided for general educational and informational purposes only. It reflects the personal opinions and experience of Scott West as a private trader. Nothing on this site constitutes financial, investment, trading, tax, accounting, or legal advice, and nothing here should be construed as a recommendation, offer, or solicitation to buy, sell, or hold any futures contract, option, security, currency, digital asset, or other financial instrument, or to adopt any trading strategy.
2. No professional relationship
Scott West is not a registered investment adviser, broker-dealer, financial planner, commodity trading advisor (CTA), commodity pool operator (CPO), or introducing broker, and is not registered with or licensed by the U.S. Securities and Exchange Commission, the Commodity Futures Trading Commission, the National Futures Association, FINRA, or any state or foreign regulator. No content on this site creates an advisory, fiduciary, or client relationship of any kind. You are solely responsible for your own trading and investment decisions and for evaluating the risks of any strategy or product discussed here.
3. Risk of loss in futures trading
Trading futures, options on futures, and other leveraged instruments involves substantial risk of loss and is not suitable for all investors. The high degree of leverage available in futures trading can work against you as well as for you. You could sustain a total loss of your initial margin funds and any additional funds you deposit to maintain your position, and you may be required to deposit additional funds on short notice. Only risk capital, money you can afford to lose without affecting your lifestyle, should be used for trading. The overnight (Globex) session can be thinner than the day session, which can mean wider spreads and faster moves around news. You should carefully consider whether trading is appropriate for you in light of your experience, objectives, financial resources, and other relevant circumstances.
4. Hypothetical and simulated performance
Some results described on this site come from simulated trading, practice accounts, or proprietary-trading-firm evaluation and funded accounts, which are simulated environments. The following disclosure is made in accordance with CFTC Rule 4.41:
HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS, SOME OF WHICH ARE DESCRIBED BELOW. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. IN FACT, THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND THE ACTUAL RESULTS SUBSEQUENTLY ACHIEVED BY ANY PARTICULAR TRADING PROGRAM. ONE OF THE LIMITATIONS OF HYPOTHETICAL PERFORMANCE RESULTS IS THAT THEY ARE GENERALLY PREPARED WITH THE BENEFIT OF HINDSIGHT. IN ADDITION, HYPOTHETICAL TRADING DOES NOT INVOLVE FINANCIAL RISK, AND NO HYPOTHETICAL TRADING RECORD CAN COMPLETELY ACCOUNT FOR THE IMPACT OF FINANCIAL RISK IN ACTUAL TRADING. FOR EXAMPLE, THE ABILITY TO WITHSTAND LOSSES OR TO ADHERE TO A PARTICULAR TRADING PROGRAM IN SPITE OF TRADING LOSSES ARE MATERIAL POINTS WHICH CAN ALSO ADVERSELY AFFECT ACTUAL TRADING RESULTS. THERE ARE NUMEROUS OTHER FACTORS RELATED TO THE MARKETS IN GENERAL OR TO THE IMPLEMENTATION OF ANY SPECIFIC TRADING PROGRAM WHICH CANNOT BE FULLY ACCOUNTED FOR IN THE PREPARATION OF HYPOTHETICAL PERFORMANCE RESULTS AND ALL OF WHICH CAN ADVERSELY AFFECT ACTUAL TRADING RESULTS.
5. Past performance and results not typical
Past performance, whether Scott West’s, any prop firm’s, or any other trader’s, is not indicative of future results. Any journal entries, session summaries, evaluation passes, payouts, or other results referenced on this site are personal, unaudited, selected, and not typical. They describe one trader’s experience over specific periods with specific sizing and specific mistakes, and they are not a projection or promise of what you will achieve. Most people who attempt to trade futures lose money. No representation is made that you will earn any income or achieve any result by following anything on this site or by purchasing any product or service linked from it.
6. Third-party products and prop firms
Reviews and mentions of proprietary trading firms, brokers, platforms, indicators, and tools reflect publicly available information and personal experience at the time of writing; rules, fees, and features change without notice and you must read the provider’s current terms before purchasing. Proprietary-trading-firm evaluation and funded accounts are simulated accounts governed by the firm’s own rules, including rules about holding positions overnight and through news, and payouts are subject to those rules, which Midnight Futures does not control.
7. Affiliate and material-connection disclosure
In accordance with the U.S. Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255), you should assume that some links on this site are affiliate or referral links, and that Midnight Futures may receive a commission or other compensation if you click them or purchase through them, at no additional cost to you. Outbound commercial links use a /go/ address so they can be identified. Compensation never determines whether a product is mentioned or what is said about it. See the Affiliate Disclosure.
8. Accuracy, availability, and changes
Content is provided “as is” without warranty of any kind, express or implied. While care is taken to be accurate, Midnight Futures makes no representation that information is complete, current, or error-free, and may change or remove content at any time without notice. Third-party sites linked from here are outside Midnight Futures’ control and have their own terms and policies.
9. Limitation of liability
To the fullest extent permitted by law, Midnight Futures, Scott West, and any contributors shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including trading losses, lost profits, or loss of data, arising from or related to your use of this site, reliance on its content, or any product or service linked from it, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the site is to stop using it.
10. Do your own due diligence
Before trading, consult a licensed financial professional who understands your circumstances, read the risk disclosures provided by your broker and any prop firm, and confirm that you understand the rules and costs of every product you use. If you do not agree with this disclaimer, do not use this site.
